Now popular fake advocate Brian Mwenda Njagi has finally being arrested.
Brian Mwenda was arrested on the night of Tuesday, October 17, just moments after grilling at the DCI Headquarters along Kiambu Road.
The fake advocate will spend the night behind bars at the Muthaiga Police Station, YEIYO.com has learnt.
News of his arrest was first made public by Mike Sonko through his social media pages.
The former Governor posted a video showing Brian Mwenda being escorted to Muthaiga Police Station by police and a number of people including the flamboyant politician.
“Still at the DCI HQS. Brian Mwenda is being escorted to Muthaiga Police Station.” Mike Sonko wrote.
The politician, who is Brian Mwenda’s defender disclosed a team of lawyers are trying to apply for police bail so that he can be released pending court cases.
“We shall try to make efforts to apply for police bail. More updated to follow,” Added Mike Sonko.
YEIYO.com understands Brian Mwenda was arrested after many hours of grilling at DCI Headquarters where he had presented himself in the company of Mike Sonko and other supporters.
The arrest came hot on the heels of a formal statement from The Law Society of Kenya (LSK) President Eric Theuri who disclosed Brian Mwenda faces several charges of identity theft and forgery.
Through his statement sighted by this writer on Twitter, Eric Theuri reiterated that the lawyers’ body will ensure Brian Mwenda is prosecuted to the full extent of the law.
He added that the case will act as a perfect example to those who may want to go down the same path in the future.
“Brian Mwenda Njagi is now at DCI. We are going to ensure that he faces the full force of the Law. The evidence gathered so far points to several cases of forgery & identity theft,” Theuri wrote.
“Further inquiries are ongoing. We are working closely with the DCI team to conduct thorough & extensive investigations. This case will be a deterrent for future masqueraders.” he added.
Brian Mwenda’s lawyer, Danstan Omari had earlier written to DCI requesting to be allowed to present his client for questioning on Wednesday, October 18.
In his letter, Danstan Omari said he was engaged in court on another matter but his client is willing to cooperate with police in the investigations.
“Our client has with utmost concern been made aware of publicized controversies pertaining that have ensued from the recent announcements by the Law Society of Kenya. Further to the above, our client wishes to reiterate his unequivocal willingness to assist in any investigations (if any) all intent on setting the record straight. However, his advocate Danstan Omari is engaged at the Chief Magistrate’s court at JKIA Law courts in MCCR E1137/2023: Republic V Handrianus Theodorus Putra and will avail his client tomorrow on the 18th day of October 2023 at noon. Our client like all citizens enjoys the constitutionally prescribed presumption of innocence and a right to counsel.” the letter read in part.
“We therefore write seeking that any summons and/or actions against our client be held in abeyance/deferred until the 18th day of October at noon when he will avail himself to record a statement duly represented by counsel of choice.” the letter added.
Brian Mwenda recently made national and regional headlines after being unmasked as a fake advocate.
