Vocal Embakasi East MP Babu Owino is finally a free man after the court on Tuesday, August 29, acquitted him of firearm misuse charges against his friend Felix Orinda, alias DJ Evolve.
Babu Owino had been in court for about three years after he was accused of shooting DJ Evolve, with whom he was making merry in a Kilimani-based wet hole.
Delivering the verdict, senior Principal Magistrate Bernard Ochoi noted that the prosecution could not positively prove Baby Owino was actually drunk and disorderly during the shooting incident.
Principal Magistrate Bernard Ochoi, while adding to his verdict held that the prosecution failed to prove before the court that the bullet that hit DJ Evolve was fired from MP Babu Owino’s pistol.
According to the Magistrate, the case was of public interest but the investigations team did not do a good job, specifically on exhibits.
He added that among the reason for Babu Owino’s acquittal was the fact that the Embakasi East MP has been taking good care of the victim, DJ Evolve.
“Taking all the above into account, I have come to the conclusion that this is a matter where the court should encourage reconciliation as envisaged in the constitution and therefore I will allow the withdrawal against the accused in count one. The accused is acquitted,” said Ochoi.
Responding to the court verdict outside the Milimani Law Courts, Babu Owino vowed to walk with DJ Evolve in his journey towards recovery.
The ODM MP disclosed that he is planning to take care of all DJ Evolve’s medical bills even as he looks forward to fly to India for further treatments.
“I will walk by DJ Evolve. I will always be there for him. I’m planning to take him to India for further treatment,” he said.
